Landlord Responsibility


Every owner and operator of any building who rents, leases or lets one or more dwelling units or sleeping units on terms, either expressed or implied shall supply:

  • conditioned air to the occupants thereof during the period from April 1 through November 1 to maintain a temperature of 20°F lower than the outside temperature or 85°F (29°C) whichever is warmer in all habitable rooms, bathrooms and toilet rooms, or supply insect screens for all doors and windows and other openings
  • heat during the period from November 1 through April 1 to maintain a temperature of not less than 65°F (18°C) in all habitable rooms, bathrooms and toilet rooms

Residential Occupancies


Dwellings shall be provided with:
  • conditioned air facilities capable of maintaining a room temperature of 20°F lower than the outside temperature or 85°F (29°C) whichever is warmer in all habitable rooms, bathrooms and toilet rooms
  • heating facilities capable of maintaining a room temperature of 65°F (18°C) in all habitable rooms, bathrooms and toilet rooms Cooking appliances shall not be used to provide space heating to meet the requirements of this section

Occupiable Work Spaces


Indoor occupiable work spaces shall be supplied with:
  • conditioned air during the period from April 1 through November 1 to maintain a temperature of 20°F lower than the outside temperature or 85°F (29°C) whichever is warmer during the period the spaces are occupied, or supply insect screens for all doors and windows and other openings
  • heat during the period from November 1 through April 1 to maintain a temperature of not less than 65°F (18°C) during the period the spaces are occupied
