    FEBRUARY 2006 CITY COUNCIL REGULAR MEETING

    NOTICE OF REGULAR MEETING

    RED OAK CITY COUNCIL

    Notice is hereby given that the Regular Meeting of the Red Oak City Council will be held on Monday, February 13, 2006 at 7:00 P.M., in the Council Chambers of the Red Oak Municipal Center, 200 Lakeview Parkway, Red Oak, Texas, at which time the following will be discussed and considered to wit:

    1. CALL TO ORDER – The Mayor will call the meeting to order, declare a quorum if present, and declare notices legally posted pursuant to Open Meetings Act.
    2. INVOCATION AND PLEDGE OF ALLEGIANCE
    3. CONSENT AGENDA – Consent Items

    “All matters listed under Item III. Consent Agenda, are considered to be routine by the City Council and will be enacted by one motion. There will not be a separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately.”

    1. Consideration of approving the minutes of the January 9, 2006 Regular City Council Meeting, the January 23, 2006 and January 26, 2006 Special City Council Meetings/Workshops.
    2. Consideration of approving the absence of Mayor Pro Tem Gary Autrey from the January 9, 2006 Regular City Council Meeting.
    3. Consideration of approving a contract for the purchase of land for the new Fire & Police substation in the amount of $33,000, for 1.5 acres, located on Pierce Road, east of Castle Ridge and west of Pratt Road.
    4. Consideration of approving a Resolution authorizing the filing of a Statewide Transportation Enhancement Program Grant application with the Texas Department of Transportation and authorizing the City Manager to act on behalf of the City in all matters related to the application.
    5. Consideration of approving a bid on a 16 inch water line and on a 12 inch water line east from Harmony subdivision.
    6. Consideration of approving a Texas Water Development Board Grant for a Flood Mitigation Action Plan.
    7. Consideration of approving an Ordinance repealing the Code of Ordinances Section 35.80: Bidding Procedures and Sections 37.020 through 37.027: Creation of Office of City Administrator.
    8. Consideration of approving an Interlocal Cooperation Contract between the City of Red Oak and Ellis County for the maintenance, repair and/or construction of streets, roads, alleys, bridges, parking areas, waterways and ditches.
    9. Consideration of approving a Resolution calling for a City of Red Oak General Election to be held on May 13, 2006, establishing procedures for that election, authorizing a new method of voting for the handicapped, and providing an effective date.
    10. Consideration of approving a Interlocal Agreement between the City of Red Oak and the City of Lancaster, Texas, to work together on a major road and water line project on Houston School Road.
    11. Consideration of approving a contract for engineering services with Black & Veach for the Dallas Water Line project.
    12. Consideration of approving a contract for $3,000 per month with C & C Engineering to perform the City of Red Oak energy code inspections.
    13. Consideration of approving a Resolution adopting a written Investment Policy and designating Investment Officers.
    14. Consideration of approving a Resolution and application for participation in the Texas Short Term Asset Reserve Program (TexSTAR) for investment opportunities.
    15. Consideration of approving a training grant from the Texas Forest Service for the Red Oak Fire Department.

    V. COUNCIL BUSINESS – OPEN SESSION

    P. Introduction and consideration of approving appointments and resignations to the IDC Board, the CIP Committee, the GO Bond Committee, the Parks & Recreation Board and the Library Advisory Board.

    Q. Consideration of approving the 2005 Fiscal Year end audit.

    R. Conduct a Public Hearing and consideration of approving an Ordinance granting an amendment to the Development Plan for Main Street Plaza, allowing the sale of alcoholic beverages in restaurants located in Main Street Plaza; or approving an Ordinance for a Specific Use Permit allowing alcoholic beverages for the River Bottom Café located in Main Street Plaza; 205 S. Main Street, being Lot 2R, Block B, Red Oak Business Park, City of Red Oak, Ellis County, Texas, further described as being located west of Highway 342 and south of Red Oak Road.

    S. Conduct a Public Hearing and consideration of approving an Ordinance for an Amended Development Plan for Lot 1, Block 1, Red Oak Plaza, City of Red Oak, Ellis County, Texas, located south of Ovilla Road at Plaza Drive and west of Interstate 35,  requested by Summerhill Development.  

    T. Consideration of approving a 30” versus a 36” diameter size water line for the Dallas Water Line project. 

    U. Consideration of approving the use of the Municipal Center conference rooms by ROISD High School student sports and cheerleader organizations at a reduced rental rate.

    V.  Consideration of approving any action as a result of discussion in Executive Session Item A.

     VI. EXECUTIVE SESSION
      
      Pursuant to Section §551.071 of the Texas Government Code (the “Act”), the Council reserves the right to convene in Executive Session(s), from time to time as deemed necessary during this meeting for any posted agenda item, to receive advice from its attorney as permitted by law.
      In addition, the City Council will convene in Executive Session under Section §551.071 of the Act for the following:

    A. To receive advice from its attorney concerning the Palmer Community Action Group; ET AL vs. City of Red Oak, County of Ellis Cause No. 69600.

    VII. REPORTS

          City Manager Report to Council.

    Lancaster Workshop, UDC update, Disaster Plan update, Utility and fee payments options, TXDOT schedules and update, COG, TXDOT and HOME Grants, Parks & Recreation survey update and joint meeting, Finance Manual update, Hazard Mitigation schedule, Permit Fee study, ISP options, GO & CIP Bond Issue projects update and 2007 Budget.

    VIII. CITIZENS TO BE HEARD

    Comments, questions, or presentations for non-agenda items from citizens, but no action may be taken by City Council.

    IX. ADJOURNMENT
