NOTICE OF REGULAR MEETING
RED OAK CITY COUNCIL
Notice is hereby given that a Regular Meeting of the Red Oak City Council will be held on Monday, December 10, 2007 at 7:00 P.M., in the Council Chambers of the Red Oak Municipal Center, 200 Lakeview Parkway, Red Oak, Texas, at which time the following will be discussed and considered:

I. CALL TO ORDER – The Mayor will call the meeting to order, declare a quorum if present, and declare notices legally posted pursuant to Open Meetings Act.

“All matters listed under Item IV. Consent Agenda, are considered to be routine by the City Council and will be enacted by one motion. There will not be a separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately.”
E. Consider approval of the minutes of the October 29, 2007, Special City Council Meeting and the November 13, 2007, Regular City Council Meeting.
F. Consider approval appointing one elected official and one technical member to the Outer Loop/Rail Bypass Study Area Stakeholder Roundtable.
G. Consider approval of the City Managers appointment of David Hall to the position of Public Works Director.
H. Consider approval of purchasing 0.012 acres of permanent right-of-way for the Red Oak Road expansion.
I. Consider approval of a property exchange agreement between the City of Red Oak and Charles T. Dillabough and Judy Dillabough for 0.023 acres in regard to the Red Oak Road expansion.
J. Consider rejecting bid from Charles T. Dillabough for approximately 0.108 acres, a part of Block 1, Sullivan’s Addition to Red Oak, Texas, according to the plat recorded in Volume 196, page 603 of the Deed records of Ellis County, Texas.
V. COUNCIL BUSINESS - OPEN SESSION
K. Continue the Public Hearing and consider approval of an Ordinance for a Specific Use Permit for a 1,200 square feet brick accessory building for 311 Meadow Lane, being Lot 3, Block 3, Green Valley Acres, City of Red Oak, Ellis County, Texas, located south of Pierce Road and east of Lowrance Rd, requested by Al Thomas.
L. Continue the Public Hearing and consider approval of an Ordinance for a Specific Use Permit for allowing Major Auto Repair in Commercial-1 (C-1) zoning for 401 N. Hwy. 342, being .2968 acres, McKinney & Williams Survey, A-751, City of Red Oak, Ellis County, Texas, located south of Ovilla road and west of Hwy. 342, requested by Lazaro Vargas.
M. Conduct a Public Hearing regarding whether to tax tangible personal property in transit and consider approval of an Ordinance to tax tangible personal property in transit which would other wise is exempt pursuant to Texas Tax Code, Section 11.253.
N. Presentation regarding Bureau Veritas regulatory compliance services.
O. Discussion and possible action regarding an agreement between 2TURNITON, Inc. and the City of Red Oak.
P. Discussion and possible action regarding a developer’s agreement with Howitzer International.
Q. Discussion and possible action regarding an ordinance amending the budget for FY 2007/2008.
R. Discussion and possible action regarding a resolution to cast votes to elect directors for the Ellis Central Appraisal District for the years 2008-2009.
S. Discussion and possible action regarding City Managers cell phone number.
VI. EXECUTIVE SESSION - Pursuant to the Open Meetings Act, Chapter 551, Texas Government Code, the City Council for the City of Red Oak reserves the right to adjourn into Executive Session at any time during the course of this meeting to discuss any of the matters listed above, as authorized by Texas Government Code Sections §551.071 (Consultation with Attorney).
A. The City Council will convene in Executive Session pursuant to Section 551.072 (Deliberations about Real Property) to deliberate the purchase of park property located within the City of Red Oak
B. The City Council will convene into Executive Session pursuant to § 551.071 to seek advise from special legal counsel and the City Attorney on the following:
(1) To receive advice concerning the Palmer Action Group; ETAL vs. City of Red Oak, County Ellis Cause No. 69600; and the Ferris annexation east of the City of red Oak city limits, southeast of Stainback Road, northwest of FM 664 and west of Ferris Road.
(2) To receive advice regarding a claim filed against the City by Thomas Coppock.
