NOTICE OF PUBLIC HEARINGS AND REGULAR MEETING
RED OAK CITY COUNCIL
MONDAY, AUGUST 11, 2008, 7:00 P.M.
Pursuant to Section 551 of the Texas Government Code, notice is hereby given of a Regular Meeting of the Red Oak City Council to be held on Monday, July 14, 2008, at 7:00 P.M., in the Council Chambers of the Red Oak Municipal Center, 200 Lakeview Parkway, Red Oak, Texas, at which time the following will be discussed and considered:

Pursuant to Section 551 of the Texas Government Code, notice is hereby given of a Public Hearing and Regular Meeting of the Red Oak City Council to be held on Monday, August 11, 2008, at 7:00 P.M., in the Council Chambers of the Red Oak Municipal Center, 200 Lakeview Parkway, Red Oak, Texas, at which time the following will be discussed and considered:
CALL TO ORDER: The Mayor will call the meeting to order, declare a quorum if present, and declare notices legally posted pursuant to Open Meetings Act.
INVOCATION AND PLEDGE OF ALLEGIANCE:
CITIZEN FORUM:
At this time, any person with business before the Council not scheduled on the agenda may speak to the Council. No formal action can be taken on these items at this meeting.
CONSENT AGENDA:
Consent Agenda items are considered to be routine in nature and may be acted upon in one motion. Any item requiring additional discussion may be withdrawn from the Consent Agenda by the mayor, councilmember or city manager, and acted upon separately.
1. Consider and/or action regarding approval of the following Minutes:
• June 9, 2008 – Regular Council Meeting
• July 14, 2008 – Regular Council Meeting
• July 31, 2008 – Called Council Meeting/ Budget Workshop
2. Discussion and possible action regarding an Ordinance (08-55) amending the Fiscal Year 2007-2008 Budget for the City of Red Oak Economic Development Corporation. (T. Fuller)
3. Discussion and possible action regarding an Ordinance (08-56) amending the Fiscal Year 2007-2008 Budget for the City of Red Oak Industrial Development Corporation. (T. Fuller)
4. Discussion and possible action regarding a Resolution (08-16R) initiating annexation of a Tract of land located in the ETJ of the City: Located generally south of Ovilla Road, west of Batchler Road, east of Pratt Road and north of Rock Creek Lane, consisting of approximately 69.137 acres of land situated in the R. Crow Survey, Abstract 199 and in the HP Crum Survey, Abstract 280. (T. Fuller)

Section 551.071: As authorized by Chapter 551 of the Texas Government Code, the City council reserves the right to adjourn into Executive Session at any time during the course of this meeting to seek legal advice from the City Attorney about any matters listed on the agenda.
5. PUBLIC HEARINGS:
A. Conduct a Public Hearing to allow questions or comments regarding the 2007 Consumer Confidence Report (Drinking Water Quality Report). (D.Kennedy)
B. Conduct a Public Hearing for Curfew Hours for Minors in the City of Red Oak. (C. Rudolph)
6. Presentation, discussion and possible action regarding: Storm Water Utilities Implementation presented by Ms. Diane Palmer, Palmer Price, Inc.:
7. Discussion and possible action regarding an Ordinance (08-48) providing for Curfew Hours for Minors in the City of Red Oak, for a period of three (3) years, defining terms; creating offenses for minors, parents and guardians of minors and business establishments for violating curfew regulations. (C. Rudolph)
8. Discussion and possible action regarding an Ordinance (08-47) establishing a Building and Standards Commission and implementing Subchapter C, Chapter 54, of the Local Government Code; Providing for Quasi-Judicial enforcement of Health and Safety Ordinances dealing with matters of public safety relating to materials or methods used to construct buildings or improvements; relating to fire safety; relating to dangerous or deteriorated buildings or improvements; and relating to conditions caused by the accumulation of refuse and other matters that create breeding and living places for insects and rodents. 9. EXECUTIVE SESSION:
Section 551.071: As authorized by Chapter 551 of the Texas Government Code, the City council reserves the right to adjourn into Executive Session at any time during the course of this meeting to seek legal advice from the City Attorney about any matters listed on the agenda, in addition to the following matters:
A. Section 551.071, Consultation with Attorney: To receive advice concerning the City of Red Oak vs. Primary Media, Ellis County Cause No. 76260. (T.Fuller)
C. Section 551.071, Consultation with Attorney: To receive legal advice on litigation concerning property located at 1250 and 1254 Pratt Road situated in the R.A. Lemmans Survey, Abstract No. 628, Ellis County, Texas and consisting of two Tracts, A 7.782 acre tract of land and 5.824 acre tract, Ellis County, Texas, within the extraterritorial jurisdiction of the City of Red Oak, Texas. D. Section 551.071, Consultation with Attorney: To receive advice concerning the Palmer Action Group et al vs. City of Red Oak settlement, County Ellis Cause No. 69600, and to receive advice of counsel on legal issues pertaining to related agreements with property owners and annexation matters pursuant to the attorney’s ethical duty to advise the City.
