MINUTES OF SPECIAL MEETING
RED OAK CITY COUNCIL
Notice is hereby given that a Special Meeting of the Red Oak City Council will be held on Tuesday, June 20, 2006, at 6:30 P.M., in the Council Chambers of the Red Oak Municipal Center, 200 Lakeview Parkway, Red Oak, Texas, at which time the following will be discussed and considered, to wit:

I. CALL TO ORDER – The Mayor will call the meeting to order, declare quorum if present, and declare notices legally posted pursuant to Open Meetings Act.
Mayor Ron Bryce called the meeting to order at 6:33 P.M. Members present were: Mayor Ron Bryce, Councilmember Eric Smith, Councilmember Scott Lindsey, Councilmember Casey Hargrove and Councilmember Gary Autrey. A quorum was declared present and all notices posted. Mayor Pro Tem Ben Goodwyn arrived during Open Session, Agenda Item A.
II. INVOCATION & PLEDGE OF ALLEGIANCE
Councilmember Hargrove gave the Invocation and led the Council and Citizens in the Pledge of Allegiance.
III. COUNCIL BUSINESS – OPEN SESSION
A. Consideration of approving an Ordinance for a zoning change from Agriculture (AG) to Planned Development (PD) and a Development Plan, for Lot 1, Block 1, Josey Acres, an addition to the City of Red Oak, Ellis County, Texas, according to the plat recorded in Cabinet B, Slide 24, requested by Steve Skipper, contingent on annexation of property.
Councilmember Autrey made the motion, seconded by Mayor Pro Tem Goodwyn to remove this Agenda Item from the table of the June 12, 2006 Regular Meeting. The motion was unanimous. Councilmember Smith made the motion, seconded by Mayor Pro Tem Goodwyn to approve Ordinance No. 06-20: AN ORDINANCE AMENDING ORDINANCE NO. 89-02, THE UNIFIED DEVELOPMENT CODE BY APPROVING A ZONING CHANGE FROM AGRICULTURAL “AG” TO PLANNED DEVELOPMENT “PD” AND APPROVING A DEVELOPMENT PLAN, FOR THE SKIPPER ADDITION, LOT 1, BLOCK, 1, JOSEY ACRES, APPROXIMATELY 1.1277 ACRES OF LAND, ACCORDING TO THE PLAT RECORDED IN CABINET B, SLIDE 24, PLAT RECORDS, ELLIS COUNTY, TEXAS, AN ADDITION TO THE CITY OF RED OAK, ELLIS COUNTY, TEXAS; AMENDING THE OFFICIAL ZONING MAP; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE with the condition that the school driveway would be closed of and the access easement would be worked out between Steve Skipper and the ROISD. The motion was unanimous.
B. Consideration of approving an Ordinance for the annexation of approximately 1.1277 acres of land west of Lowrance Road, south of FM Highway 2377 and northwest of Josey Lane and abutting the existing city limits of Red Oak, requested by Steve Skipper.
Councilmember Autrey made the motion, seconded by Councilmember Hargrove to remove this Agenda Item from the table of the June 12, 2006 Regular Meeting. The motion was unanimous. Councilmember Lindsey made the motion, seconded by Councilmember Hargrove to approve Ordinance No. 06-17: AN ORDINANCE PROVIDING FOR THE ANNEXATION INTO THE CITY OF RED OAK OF TERRITORY MORE SPECIFICALLY DESCRIBED BELOW GENERALLY COMPRISING APPROXIMATELY 1.127 ACRES, LOCATED IN JOSEY ACRES, LOT 1, BLOCK 1, SOUTH OF F. M. 2377, NORTHWEST OF JOSEY LANE, WEST OF LOWRANCE ROAD, CITY OF RED OAK, ELLIS COUNTY, TEXAS, FOR ALL MUNICIPAL PURPOSES; APPROVING A SERVICE PLAN FOR SUCH TERRITORY; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. The motion was unanimous.
C. Consideration of approving the removal of a sidewalk and a driveway along Ovilla Road fronting Red Oak Drugs for the purpose of expanding the roadway.
Mayor Pro Tem Goodwyn made the motion, seconded by Councilmember Lindsey to approve the removal of a sidewalk and a driveway along Ovilla Road fronting Red Oak Drugs for the purpose of expanding the roadway with the condition that negotiations continue with the property owners and Wal-Mart.
D. Update from staff concerning possible water rationing in the City of Red Oak.
City Engineer David Ridgway updated Council on the reasons for possible water rationing in the City of Red Oak due to lack of rain and increased water usage.
IV. ADJOURNMENT
Mayor Bryce adjourned the meeting at 7:06 P.M.
