MINUTES OF SPECIAL MEETING
RED OAK CITY COUNCIL
TUESDAY, JUNE 19, 2007
I. CALL TO ORDER – The Mayor will call the meeting to order, declare a quorum if present, and declare notices legally posted pursuant to Open Meetings Act.
Mayor Bryce called the meeting to order at 7 p.m. and declared a quorum present and notices legally posted. Members present were Mayor Ron Bryce, Mayor Pro Tem Ben Goodwyn, Councilmember Eric Smith, Councilmember Scott Lindsey, Councilmember Casey Hargrove and Councilmember Andy Bell.
II. INVOCATION & PLEDGE OF ALLEGIANCE
Pastor David Johnson gave the Invocation and Mayor Bryce led the Council and Citizens in the Pledge of Allegiance.
III. COUNCIL BUSINESS – OPEN SESSION
A. Discussion and evaluation of the employment of the City Attorney and consideration of approving any action as a result.
Councilmember Smith made the motion, seconded by Mayor Pro Tem Goodwyn to immediately terminate the City Attorney and direct the HR Director to search for three law firms and submit to City Council for appointment. The motion carried 3 – 2 with Councilmember Smith, Mayor Pro Tem Goodwyn and Councilmember Hargrove voting in favor of the termination; and Councilmember Lindsey and Councilmember Bell voting in opposition.
B. Discussion and evaluation of the employment of the City Manager and consideration of approving any action as a result.
Councilmember Hargrove made the motion, seconded by Mayor Pro Tem Goodwyn to terminate the employment of the City Manager effective July 1, 2007 and effective immediately until that point the City Manager would be suspended from office; and further moved that they appoint a five person committee with each representative from council to coordinate with the HR Director and select five candidates for the new city manager position. The motion carried 3 – 2 with Councilmember Hargrove, Mayor Pro Tem Goodwyn and Councilmember Smith voting in favor of the termination; and Councilmember Lindsey and Councilmember Bell voting in opposition.
C. Discussion of violations concerning the Open Meetings Act, Code of Ethics, investigative powers, conflict of interest, inappropriate communications and consideration of approving any action as a result.
Mayor Bryce stated that Item Agenda C had been pulled per request.
IV. ADJOURNMENT
Mayor Bryce adjourned the meeting.
