MINUTES OF SPECIAL MEETING
RED OAK CITY COUNCIL
MONDAY, SEPTEMBER 17, 2007
I. CALL TO ORDER – The Mayor Pro Tem will call the meeting to order, declare a quorum if present, and declare notices legally posted pursuant to Open Meetings Act.
Deputy Mayor Pro Tem Eric Smith called the meeting to order and declared a quorum present and notices legally posted. Members present were Deputy Mayor Pro Tem Eric Smith, Councilmember Scott Lindsey and Councilmember Casey Hargrove. Mayor Pro Tem Ben Goodwyn and Councilmember Andy Bell were not present.
II. INVOCATION & PLEDGE OF ALLEGIANCE
Councilmember Lindsey gave the Invocation and Councilmember Hargrove led the Council and Citizens in the Pledge of Allegiance.
III. CONSENT AGENDA
A. Consideration of approving a Resolution providing for and consenting to the exercise of eminent domain and providing for the acquisition by eminent domain of a permanent right-of-way within the municipal boundaries of the City of Red Oak, located in the George C. Parks Survey, Abstract No. 830, City of Red Oak, Ellis County, Texas, and being more particularly described in Exhibit “A” attached.
B. Consideration of approving the amendment of the contract for library services with LSSI to add a 5% merit for librarian salaries for FY 2008.
Councilmember Hargrove made the motion, seconded by Councilmember Lindsey to approve Consent Agenda Item A, Resolution No. 07-18: A RESOLUTION PROVIDING FOR AND CONSENTING TO THE EXERCISE OF EMINENT DOMAIN AS AUTHORIZED BY THE CITY COUNCIL OF THE CITY OF RED OAK, TEXAS; PROVIDING FOR THE ACQUISITION BY EMINENT DOMAIN OF A PERMANENT RIGHT-OF-WAY WITHIN THE MUNICIPAL BOUNDARIES OF THE CITY OF RED OAK; DECLARING A PUBLIC NECESSITY EXISTS AND FINDING A PUBLIC USE AND PURPOSE FOR THE WELFARE AND CONVENIENCE OF THE CITIZENS, REQUIRES THE TAKING AND ACQUIRING OF A PERMANENT RIGHT-OF-WAY FOR PUBLIC PURPOSES, THAT CERTAIN TRACT WHICH WILL BE BURDENED WITH THE PERMANENT RIGHT-OF-WAY IS SITUATED IN THE GEORGE C. PARKS SURVEY, ABSTRACT NO. 830, CITY OF RED OAK, ELLIS COUNTY, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT “A,” WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN BY REFERENCE; PROVIDING FOR AN OFFER TO PURCHASE THE PERMANENT RIGHT-OF-WAY FOR JUST COMPENSATION AND IF SUCH OFFER IS REFUSED, AUTHORIZING COUNSEL TO INSTITUTE NECESSARY PROCEEDINGS IN CONDEMNATION TO ACQUIRE THE PROPERTY FOR UTILITY PURPOSES; AND PROVIDING FOR AN EFFECTIVE DATE; and B. The motion was unanimous 3 – 0.
IV. COUNCIL BUSINESS – OPEN SESSION
C. Consideration of approving an Ordinance adopting the Fiscal Year 2007 – 2008 Official Budget for the City of Red Oak, Texas for the fiscal year beginning October 1, 2007 and ending September 30, 2008; and providing for the investment of funds.
Councilmember Hargrove made the motion, seconded by Councilmember Lindsey to approve Ordinance No. 07-24: AN ORDINANCE ADOPTING THE OFFICIAL BUDGET FOR THE CITY OF RED OAK, TEXAS FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2007 AND ENDING SEPTEMBER 30, 2008; PROVIDING FOR THE INVESTMENT OF FUNDS; AND PROVIDING FOR AN EFFECTIVE DATE. The motion was unanimous 3 – 0 with Councilmember Hargrove, Councilmember Lindsey and Deputy Mayor Pro Tem Smith voting in favor and no one voting in opposition.
D. Consideration of approving an Ordinance by record vote of the Red Oak City Council, levying and assessing municipal ad valorem taxes for the City of Red Oak, for the Fiscal Year 2007-2008, at $0.5585 cents for Maintenance and Operations and $0.0765 cents for Interest and Sinking Funds, for a total of $0.635 cents per $100 of assessed valuation. This tax rate will raise more taxes for maintenance and operations than last year’s tax rate. The tax rate will raise taxes on a $100,000 home by approximately ($18.40) per year.
Councilmember Lindsey made the motion, seconded by Councilmember Hargrove, that property taxes be increased by the adoption of a tax rate of $0.635. The motion was unanimous 3 – 0 with Councilmember Lindsey, Councilmember Hargrove and Deputy Mayor Pro Tem Smith voting in favor and no one voting in opposition.
E. Consideration of approving a property tax increase by record vote of the Red Oak City Council as reflected in the FY 2008 City of Red Oak Annual Budget when compared to the FY 2007 Annual Budget. This budget will raise more total property taxes than last year’s budget by $524,089 or 20.56%, and of that amount $418,964 is tax revenue to be raised from new property added to the tax roll this year.
Councilmember Hargrove made the motion, seconded by Councilmember Lindsey to approve a property tax increase as reflected in the FY 2008 City of Red Oak Annual Budget when compared to the FY 2007 Annual Budget and that this budget will raise more total property taxes than last year’s budget by $524,089 or 20.56%, and of that amount $418,964 is tax revenue to be raised from new property added to the tax roll this year. The motion was unanimous 3 – 0 with Councilmember Hargrove, Councilmember Lindsey and Deputy Mayor Pro Tem Smith voting in favor and no one voting in opposition.
