CALL TO ORDER - 7:00 p.m. - Chair Barry Maners called the meeting to order at 7:05 p.m. Commissioners present were:

II. NEW BUSINESS - OPEN SESSION
Open Session Agenda Items were presented in the following order: A, F, G, B, C, D, E
A. Consideration of approving the minutes of the Monday, May 1, 2006 Regular Meeting.
Member Cornett made the motion seconded by Member Hanes to approve the minutes of the Monday, May 1, 2006 Regular Meeting. The motion was unanimous. Vice-chair Nichols made the motion seconded by Member Cornett to appoint Alan Hanes as Secretary for this meeting. The motion was unanimous
B. Consideration of approving changing the Regular Planning and Zoning Commission meeting date due to the Fourth of July holiday.
Member Hanes made the motion seconded by Member Cornett approve changing the July 2006 Regular Planning and Zoning Commission meeting to Thursday, July 6, 2006. The motion was unanimous.
C. Consideration of approving a Final Plat for Ovilla Corner, Lots 1-3, Block A, being 3.7532 acres in the Samuel Clark Survey, A-213, City of Red Oak, Ellis County, Texas, further described as being located north of Ovilla road and east of Highway 35, requested by Kimley-Horn and Associates.
Staff recommended approval. This is the Final Plat for the Prosperity Bank, Starbucks and one additional lot. Member Hanes made the motion seconded by Vice-chair Nichols to approve a Final Plat for Ovilla Corner, Lots 1-3, Block A, being 3.7532 acres in the Samuel Clark Survey, A-213, City of Red Oak, Ellis County, Texas. The motion was unanimous.
D. Consideration of approving Lots 1R and 2, Block D, Red Oak Industrial Park, an addition to the City of Red Oak, Ellis County, Texas and being a replat of Lot 1, Block D, Red Oak Industrial Park, recorded in Cabinet E, Slide 73, OPRECT, requested by Weir and Associates.
Staff recommended approval. This subdivides a ten-acre lot into two five-acre lots. Vice-chair Nichols made the motion seconded by Member Cornett to approve Lots 1R and 2, Block D, Red Oak Industrial Park, an addition to the City of Red Oak, Ellis County, Texas and being a replat of Lot 1, Block D, Red Oak Industrial Park, recorded in Cabinet E, Slide 73, OPRECT. The motion was unanimous.
E. Conduct a Public Hearing and consideration of approving a zoning change from Agriculture (AG) to Planned Development (PD) and a Development Plan for Lot 1, Block 1, Josey Acres, an addition to the City of Red Oak, Ellis County, Texas, according to the plat recorded in Cabinet B, Slide 24, OPRECT, requested by Steve Skipper.
Economic Development recommended approval. Chair Maners opened the Public Hearing. Steve Skipper, Randy Cox and Mary Leggitt spoke for the request. The following neighboring residents spoke against the request: Christi Kent, Linda Kattner, Bill Stone, Sharon Collins, Richard Kent, Joyce Chesser, Joseph Logan, Laurie Landry, Kim Kriegel, Dale Kriegel, Terry Pinson, Josh Ussery, Cheryl Sue Smith Athas, Gary Lindsey, C. E. Cheshire, Elva Costa, Don Wilson, Christy Munoz, Lori Munoz, Patricia Paks and Jill Pearson. Their issues included the additional traffic, drainage concerns, screening, and trash noise. Member Hanes made the motion seconded by Member Cornett to close the Public Hearing. The motion was unanimous. Member Hanes made the motion seconded by Vice-chair Nichols to approve a zoning change from Agriculture (AG) to Planned Development (PD) and a Development Plan for Lot 1, Block 1, Josey Acres, an addition to the City of Red Oak, Ellis County, Texas, on the following conditions: contingent upon annexation approval by City Council; requires 6’ in height split face CMU masonry wall along the border of the adjacent home, along the property line adjacent to Josey Lane and on the rear of the restaurant building (which has a patio overhang housing the barbeque pit and storage area); eliminate daycare as a use and all uses must adhere to Highway Oriented (HO) zoning criteria for uses; 100% masonry construction on all exterior walls except those that face the masonry screening walls. Those facing the screening walls may be metal; lighting in parking lot should be antique/historical style and should not encroach onto adjacent properties; relocation of the proposed dumpster neat Kent property on the southwest side of the property; eliminate the access to Josey Lane to prevent traffic problems; driveway access to be added onto Lowrance only if requested by the Fire Marshall; contingent on written agreement with Red Oak ISD for shared access on the school property. The motion was unanimous
F. Conduct a Public Hearing and consideration of approving an Amended Development Plan for the Woods of Red Oak, being a 222-lot SFR subdivision, George Parks Survey, A-836, City of Red Oak, Ellis County, Texas, further described as being located north of Red Oak Road and west of Methodist Street, requested by Tipton Engineers.
Staff recommended approval. Chair Maners opened the Public Hearing. The developer was present to speak for the request. No one was present to speak against the request. Member Hanes made the motion seconded by Vice-chair Nichols to close the Public Hearing. The motion was unanimous. Vice-chair Nichols made the motion seconded by Member Cornett to approve an Amended Development Plan for the Woods of Red Oak, being a 222-lot SFR subdivision, George Parks Survey, A-836, City of Red Oak, Ellis County, Texas, to include requiring 30% of the homes to be minimum 1750 sf living area, and require the remaining 70% minimum 2000 sq ft living area. The motion was unanimous.
G. Consideration of approving a Preliminary Plat for the Woods of Red Oak, being a 222-lot SFR subdivision, George Parks Survey, A-836, City of Red Oak, Ellis County, Texas, requested by Tipton Engineers.
Staff recommended approval. Member Hanes made the motion seconded by Vice-chair Nichols to approve a Preliminary Plat of the Woods of Red Oak, being a 222-lot SFR subdivision, George Parks Survey, A-836, City of Red Oak, Ellis County, Texas, in accordance with all zoning requirements and all engineering comments are incorporated into the plat. The motion was unanimous.
