CALL TO ORDER - 7:00 p.m. - Vice-Chair Heath Nichols called the meeting to order at 7:05 p.m.

- NEW BUSINESS - OPEN SESSION
- Consideration of approving the minutes of the Monday, April 2, 2007, Regular Meeting.
Member Moses made the motion seconded by Alternate Wilson to approve the minutes of the Monday, April 2, 2007, Regular Meeting, as presented. The motion was unanimous.
- Consideration of approving the appointment of a Chair. Vice-Chair Nichols made the motion seconded by Alternate Nevins to appoint Alan Hanes as Chair. The motion was unanimous.
- Consideration of approving the appointment of a Vice-Chair. Member Moses made the motion seconded by Alternate Nevins to table this agenda item until next month. The motion was unanimous.
- Consideration of approving the appointment of a Secretary. Vice-Chair Nichols made the motion seconded by Alternate Nevins to appoint Chris Moses as Secretary. The motion was unanimous.
- Conduct a Public Hearing and consideration of approving a zoning change from Agriculture (AG) to Commercial-1 (C-1) for approximately 0.997 acres in the George C. Parks Survey, City of Red Oak, Ellis County, Texas, located east of Interstate 35 and south of Ovilla Road, requested by Bach A. Diep. Vice-Chair Nichols opened the Public Hearing. No one was present to speak for or against the request. Secretary Moses made the motion seconded by Alternate Nevins to close the Public Hearing. The motion was unanimous. Secretary Moses made the motion seconded by Alternate Nevins to approve a zoning change from Agriculture (AG) to Commercial-1 (C-1) for approximately 0.997 acres in the George C. Parks Survey, City of Red Oak, Ellis County, Texas. The motion was unanimous.
- Conduct a Public Hearing and consideration of approving a Development Plan and zoning change from Agriculture (AG) to Planned Development zoning for Lots 3,4 and 8, Turner Estates, and from Residential-2 (R-2) to Planned Development zoning for Lot 9, Turner Estates, City of Red Oak, Ellis County, Texas, requested by Scott Green. Vice-Chair Nichols opened the Public Hearing. Scott Green, owner of the Greenery business, and neighboring residents, Pete Anderson and Jason Hogan, spoke for the request. Louis Petty and Douglas Null spoke against the request. Alternate Wilson made the motion seconded by Member Moses to close the Public Hearing. The motion was unanimous. Mr. Petty presented the Board with a petition of neighboring residents against the request. After much discussion over drainage, aerobic septic and property value concerns, Alternate Tom Wilson made the motion seconded by Alternate Nevins to approve a Development Plan and zoning change from Agriculture (AG) to Planned Development (PD) zoning for Lots 3, 4 and 8, Turner Estes and from Residential-2 (R-2) to Planned Development zoning for Lot 9, Turner Estates, City of Red Oak, Ellis County, Texas, with the following conditions: no parking is allowed in the back of Lot 8 and Lot 9; 8′ minimum privacy wood fence with crape myrtle trees 8-10 feet apart; drainage issues would be addressed. The motion carried with Member Moses, Alternate Nevins and Wilson for the request and Vice-Chair Nichols against the request.
- Conduct a Public Hearing and consideration of approving an amended comprehensive zoning ordinance for the City of Red Oak. Vice-Chair Nichols opened the Public Hearing. No one spoke for or against the request. Alternate Nichols made the motion seconded by Member Moses to close the Public Hearing. The motion was unanimous. Alternate Wilson made the motion seconded by Member Moses to approve an amended comprehensive zoning ordinance for the City of Red Oak. The motion was unanimous.
