Weekend/Evening Seasonal Sales

Weekend/evening seasonal sale - A temporary use on private property for the sale of seasonal merchandise such as firewood, Christmas trees, and snow cones.

Requirements:

Restrictions:

  • The sale must be located at an existing permanent business that holds a valid Certificate of Occupancy
  • The proprietor of the sale must have written permission from the property owner or business occupant
  • The location must have sufficient concrete parking, and the sale must not take up any of the required parking for the permanent business.
  • The sale cannot disrupt the normal flow of traffic or customers.
  • The proprietor of the sale must obtain a permit.
  • Permits issued under this section shall expire at the end of the season, on the expiration date printed on the permit, or if the use is abandoned for more than 7 days; whichever occurs first.
  • Only one permit may be issued per location at any given time, and no location may host a sale(s) for more than 60 cumulative days within any calendar year.
  • No building, trailer, vehicle, tent, or any other item whatsoever shall be left or stored at the sale location after the permit expires.
  • No buildings, whether permanent or portable, may be occupied or used for a Weekend/Evening Seasonal Sale.
  • Permits shall be issued for no more than 30 days, are valid only in the year and season for which they are issued, and only between the dates in listed in the table below.

Seasonal Calendar to Include:

  • Valentine's Day (Flowers & Gift Baskets) | February 1-28
  • Easter (Easters Baskets) | April 1-30
  • Mother's Day (Flowers, Gift Baskets) | February 1-28
  • Summer (Fruit & Snow Cones) | April 1 - September 30
  • Halloween (Pumpkins) | October 1-31
  • Winter (Firewood) | October 1 - March 31
  • Christmas (Trees & Decorations) | November 15 - December 31
  • Other Holiday (truly seasonal) | 1 day before Holiday - 1 day after Holiday 

* Other seasonal items may be allowed at the approval of the building official. No food may be sliced or prepared without a health permit.

Temporary Outside Retail Sales

Temporary outside retail sale - The sale of new merchandise outdoors, at a legally operating retail business.

Requirements:

  • Temporary Use Permit
  • Peddlers and Solicitors Permit (If selling from or upon a truck or other vehicle)

Restrictions:

  • The sale must be located at an existing permanent business that holds a valid Certificate of Occupancy
  • The proprietor of the sale must have written permission from the property owner or business occupant
  • The location must have sufficient concrete parking, and the sale must not take up any of the required parking for the permanent business.
  • The sale cannot disrupt the normal flow of traffic or customers.
  • The proprietor of the sale must obtain a permit.
  • Permits issued under this section shall be valid for 3 consecutive days
  • Only one permit per proprietor may be issued within a 90 day period.
  • If more time is needed for the sale, a specific use permit (SUP) is required.
  • Only one permit may be issued per location at any given time.
  • No buildings, whether permanent or portable, may be occupied or used for a Temporary Outside Retail Sale.
  • No building, trailer, vehicle, tent, or any other item whatsoever shall be left or stored at the sale location after the permit expires

Fund-raising Sales / Events

Fund-raising event - an event to raise funds for disaster relief, a bake sale, ticket sale, car wash, or similar event conducted for the sole purpose of raising funds to support a non-profit organization or charitable organization.

Restrictions:

  • The organization must submit proof to the city that the fund-raising activity is actually supporting a community service cause.
  • The sale / event must not impede the normal flow of vehicular and customer traffic so as to create a traffic or other hazard to the public.
  • The organization must have written permission from the landowner or the landowner's agent.
  • The duration of the sale / event shall not exceed 7 days
  • Signs must conform to the sign ordinance
